Welcome to Fusevy LLC ("Fusevy", "we", "us", or "our"). These Terms and Conditions (the "Terms") govern your access to and use of the Fusevy website, mobile application, community features, messaging features, video chat features, blogs, forums, groups, events, subscriptions, and any other products or services we provide now or in the future (collectively, the "Services").
Please read these Terms carefully. By accessing, registering for, downloading, using, purchasing, or subscribing to the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, available at https://www.fusevy.com/privacy-policy. If you do not agree, do not access or use the Services.
Important notice: These Terms include disclaimers, limits on liability, an arbitration agreement, and a waiver of class-action rights. Please review Section 20 carefully.
You must be at least eighteen (18) years old to create an account or use the Services. By using the Services, you represent and warrant that: (a) you are at least 18 years old; (b) you have the legal right, authority, and capacity to enter into these Terms; (c) you are not prohibited from using the Services under applicable law; (d) you have never been required to register as a sex offender with any government authority; (e) you have not been convicted of, and do not have pending charges for, a sexual offense or crime involving violence, abuse, exploitation, harassment, stalking, or fraud; and (f) all information you provide to us is truthful, current, accurate, and complete.
To use certain features, you may need to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately if you suspect unauthorized access to your account.
You agree not to create an account using false information, another person’s identity, automated means, or any information you do not have permission to use. We may refuse, suspend, or terminate any account that violates these Terms or appears fraudulent, abusive, unsafe, or harmful to the Services or our members.
For safety, you should not include sensitive personal contact information in your public profile, including your full legal name, home address, personal phone number, personal email address, external messenger IDs, financial information, or links intended to redirect users away from Fusevy.
Fusevy is a genuine connection platform designed to help members connect for friendship, dating, relationships, community, conversation, groups, blogs, forums, activities, and events. The Services may include profile creation, search tools, matching or compatibility features, messaging, video chat, content sharing, blogs, forums, groups, events, notifications, and premium features.
We may change, add, remove, suspend, or discontinue any feature at any time. We do not guarantee that any feature, match, message, event, connection, compatibility score, or user interaction will meet your expectations or lead to any specific result.
You may register for a free account, which may provide access to limited features. We may also offer paid subscriptions, upgrades, premium memberships, boosts, paid events, or other paid features (collectively, "Paid Services"). Paid Services, prices, billing intervals, renewal terms, and included features will be disclosed at the time of purchase.
By purchasing a Paid Service, you authorize Fusevy or our third-party payment processor to charge your selected payment method for the amount shown at checkout, including applicable taxes, fees, and recurring charges where disclosed. You represent that you are authorized to use the payment method you provide.
If a Paid Service automatically renews, we will disclose the renewal terms before you complete your purchase. Unless you cancel before the end of the current billing period, your subscription may renew automatically and your payment method may be charged at the disclosed renewal price and interval.
You are responsible for keeping your billing information accurate and current. Receipts and billing notices may be provided electronically.
We may offer free trials, discounted trials, promotional memberships, coupons, or other limited-time offers. Trial and promotional terms will be disclosed at signup. Unless otherwise stated, a trial or promotional subscription may automatically convert to a paid subscription at the end of the trial or promotional period if you do not cancel before the deadline.
Promotional offers may be limited to new users, one per person, one per payment method, or one per household, and may be changed or withdrawn at any time as permitted by law.
You may cancel a recurring subscription at any time through your account settings, the payment processor used for purchase, or any cancellation method we make available. Cancellation stops future renewal charges but does not automatically delete your account or profile.
If you purchased through a third-party payment processor or app store, you may need to cancel through that provider. We do not control every third-party billing system, but we will provide reasonable information to help you locate the correct cancellation method.
After cancellation, you may continue to receive paid features until the end of the current paid billing period, unless otherwise stated. Unless required by applicable law or expressly stated at purchase, subscriptions and Paid Services are non-refundable and we do not provide prorated refunds.
To delete your account, follow the account deletion instructions in your account settings or contact us. Some information may remain in backups, records required by law, transaction records, safety logs, moderation records, or content already shared with others, as described in our Privacy Policy.
Your safety matters. You are responsible for using caution and good judgment when interacting with other users online or offline. Do not share sensitive personal information, financial information, passwords, verification codes, or private contact details with people you do not know and trust. Never send money or financial assistance to another user.
Fusevy does not conduct criminal background checks on users and does not independently verify all user statements, identities, photos, profiles, content, messages, or claims. User profiles, messages, photos, events, and communications may be inaccurate, misleading, incomplete, or not genuine.
If you decide to meet another user in person, do so in a public place, tell someone you trust, arrange your own transportation, and use caution. We are not responsible for the conduct of users online or offline.
You may report or block users who violate these Terms or make you feel unsafe. We may review, remove, suspend, restrict, or report activity when we believe it violates these Terms, threatens safety, or may be unlawful.
You agree to use the Services respectfully, lawfully, and for personal, non-commercial purposes unless we give you written permission otherwise. You agree not to:
The Services may allow you to create, upload, post, transmit, display, or share profiles, photos, messages, videos, comments, blogs, forum posts, group content, event content, and other materials ("User Content"). You are solely responsible for your User Content and for ensuring that you have all rights necessary to share it.
By submitting User Content, you represent and warrant that your User Content: (a) is accurate to the best of your knowledge; (b) does not violate the rights of any third party, including privacy, publicity, copyright, trademark, or other intellectual property rights; (c) does not contain content involving minors in an unsafe, sexual, exploitative, or unlawful manner; and (d) complies with these Terms and applicable law.
You retain ownership of your User Content. By posting User Content, you grant Fusevy a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to host, store, reproduce, display, publish, perform, distribute, adapt, and use your User Content as reasonably necessary to operate, provide, improve, promote, and protect the Services. This license ends when you delete your User Content or account, except where retention is reasonably necessary for backup, legal, safety, moderation, enforcement, fraud prevention, dispute resolution, or where your content has been shared with others and they have not deleted it.
We may remove, restrict, edit, disable access to, or refuse to display any User Content at any time if we believe it violates these Terms, our policies, the rights of others, or applicable law.
Groups, forums, blogs, and events are intended to help members connect through shared interests, conversation, and community. You are responsible for the content you post, the events you create or attend, and your interactions with other users.
Event listings may be created by Fusevy, users, organizers, or third parties. We do not guarantee the accuracy, safety, quality, legality, availability, or outcome of any event. Attendance at any event is at your own risk.
We may remove, restrict, or cancel groups, forums, blogs, events, or event participation if we believe they violate these Terms, create safety concerns, or may be unlawful.
The Services are intended for personal use by individual users. Businesses, organizations, agencies, advertisers, marketers, recruiters, data brokers, and other commercial entities may not use the Services without our written permission. Unauthorized commercial use, data scraping, account harvesting, profile collection, solicitation, or advertising is prohibited.
By creating an account, you agree to receive transactional, administrative, service, safety, account, billing, and legal communications from us. These communications are part of the Services and may not always be optional.
You may also receive promotional communications where permitted by law. You may opt out of promotional emails by using the unsubscribe link or account settings, but you may still receive non-promotional communications.
We may use administrative, moderation, test, or staff accounts to test functionality, provide support, enforce policies, or improve the Services. Such accounts are not intended to mislead users into paid interactions.
The Services, including the design, layout, software, graphics, logos, trademarks, service marks, text, features, and other content owned by Fusevy, are protected by intellectual property and other laws. Except as expressly permitted by us, you may not copy, reproduce, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Services or our proprietary content.
You agree not to post content that infringes another person’s copyright, trademark, or other intellectual property rights. We may remove allegedly infringing content and may suspend or terminate repeat infringers.
If you believe content on the Services infringes your copyright, please send a notice to info@fusevy.com that includes: (a) your physical or electronic signature; (b) identification of the copyrighted work claimed to be infringed; (c) identification of the material claimed to be infringing and information reasonably sufficient for us to locate it; (d) your contact information; (e) a statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law; and (f) a statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.
Please be aware that knowingly misrepresenting that material is infringing may result in liability for damages, costs, and attorney’s fees.
Our Privacy Policy explains how we collect, use, disclose, and protect information about you. By using the Services, you agree that we may process information about you as described in our Privacy Policy. You are responsible for the information you choose to share publicly or with other users.
The Services may contain links to third-party websites, apps, payment processors, social media platforms, app stores, event providers, or other services. We do not control and are not responsible for third-party services, content, terms, privacy practices, or actions. Your use of third-party services is at your own risk and may be governed by separate terms.
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, Fusevy DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND QUIET ENJOYMENT.
We do not guarantee that the Services will be uninterrupted, secure, error-free, accurate, or available at any particular time. We do not guarantee any matches, introductions, communications, relationships, friendships, dates, events, compatibility, outcomes, or user conduct.
Any advice, tips, compatibility results, posts, comments, or content available through the Services are for general informational purposes only and are not professional, medical, legal, financial, mental-health, or safety advice.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Fusevy, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, SUPPLIERS, SERVICE PROVIDERS, AGENTS, SUCCESSORS, AND ASSIGNS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, REPUTATION, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO Fusevy FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED U.S. DOLLARS ($100).
You agree to defend, indemnify, and hold harmless Fusevy, its owners, officers, directors, employees, contractors, affiliates, suppliers, service providers, agents, successors, and assigns from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorney’s fees, arising out of or related to: (a) your use of the Services; (b) your User Content; (c) your interactions with other users; (d) your violation of these Terms; (e) your violation of applicable law; or (f) your violation of any rights of another person or entity.
These Terms and any dispute, claim, or controversy arising out of or relating to the Services or these Terms will be governed by the laws of the State of Texas and applicable federal law, without regard to conflict-of-law principles.
Except for claims that may be brought in small claims court, claims seeking emergency injunctive relief, or claims involving intellectual property rights, you and Fusevy agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding arbitration on an individual basis. The arbitration will be administered by a neutral arbitration provider under its applicable consumer arbitration rules, unless the parties agree otherwise.
You and Fusevy agree that any dispute will be brought only in an individual capacity and not as a class action, collective action, representative action, private attorney general action, or similar proceeding. The arbitrator may not consolidate claims of multiple users unless all parties agree in writing.
You may opt out of this arbitration agreement by sending written notice to info@fusevy.com within thirty (30) days after you first accept these Terms. Your opt-out notice must include your name, account email, and a statement that you opt out of arbitration.
If any part of this arbitration agreement or class-action waiver is found unenforceable, the unenforceable part will be severed to the extent permitted by law, and the remaining provisions will continue in effect.
We may modify the Services or these Terms from time to time. If we make material changes, we may notify you by posting the updated Terms, updating the effective date, sending an email, or providing an in-service notice. Your continued use of the Services after updated Terms become effective means you accept the updated Terms.
We may suspend, restrict, or terminate your account or access to the Services at any time if we believe you have violated these Terms, created risk or possible legal exposure, acted in a way that may harm other users or the Services, or engaged in fraudulent, abusive, unsafe, or unlawful conduct.
You may stop using the Services at any time. Certain provisions of these Terms will survive termination, including provisions related to intellectual property, User Content licenses, disclaimers, limitation of liability, indemnification, dispute resolution, and any other provisions that by their nature should survive.
If you access or download the App through Apple App Store, Google Play, or another app marketplace, your use of the App may also be subject to that marketplace’s terms and policies. The app marketplace provider is not responsible for providing support or maintenance for the Services unless required by its own terms.
We will not be responsible for any delay, failure, interruption, or inability to perform caused by events beyond our reasonable control, including natural disasters, labor disputes, power outages, internet or telecommunications failures, cyberattacks, war, terrorism, civil unrest, government action, pandemics, or other emergencies.
These Terms, together with our Privacy Policy and any purchase terms presented at checkout, constitute the entire agreement between you and Fusevy regarding the Services. If any provision is found invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of our right to enforce it later.
You may not assign or transfer these Terms without our prior written consent. We may assign or transfer these Terms, in whole or in part, in connection with a merger, acquisition, reorganization, sale of assets, change of control, or by operation of law.
